Safe to chase away barn swallow building a next

I've had one round of barn swallows build a nest, hatch and leave. I cleared the nest out after that. I've got another actively building a nest now - but there are no eggs yet. I'm assuming it's safe to chase them off at this point?

Barn Swallows are protected under the Migratory Bird Treaty Act, which is administered by the U.S. Fish and Wildlife Service. Questions regarding nest removal in Florida should be addressed to the USFWS Region 4 Migratory Bird Permit Office.
